Mobility station: Services for bicycles and pedelecs

1. Under the "Stelzenbau" of the Technical Center, Fruwirthstraße 26 (Building 02.61) in 70599 Stuttgart, the University of Hohenheim provides a collective garage for bicycles and pedelecs (20 spots) free of charge, freely accessible bicycle stands, a locker for storing utensils with charging facilities for rechargeable batteries (23 lockers), and a bicycle service station with tools for repairing bicycles and pedelecs.
2. By using the mobility station, a rental contract is concluded. The objects and rooms of the mobility station are lent to the users by the University. Furthermore, the University does not assume any duty of care for the items brought in by the users (bicycles, pedelecs, utensils, batteries) as a primary duty of performance. There is no video surveillance.
3. The University of Hohenheim is liable for all damages culpably caused by it in cases of intent and negligence - including those of employees, representatives, or vicarious agents.

For damage arising

• from a breach of the primary obligation to provide the objects and premises
• from a violation of protection and traffic safety obligations of the University of Hohenheim in connection with the provision of space

the University of Hohenheim is liable pursuant to § 599 BGB (German Civil Code) only in cases of intent and gross negligence.

Liability for indirect and unforeseen damages, loss of use, loss of profit, loss of savings, and financial losses due to claims by third parties, is excluded in the case of simple negligence.

Insofar as the liability of the University is excluded, this shall also apply to the liability of the employees, representatives, or vicarious agents.
